General information

Who is subject to the Right to Information and Protection of Privacy Act?

All public bodies are subject to the Right to Information and Protection of Privacy Act. Here is a list of public bodies in New Brunswick:

  • provincial departments, secretariats and offices, including Crown corporations and commissions;
  • Horizon Health Network, Vitalité Health Network, EM/ANB Inc. (formerly Ambulance New Brunswick),
  • the New Brunswick Health Council;
  • English and French public schools and school districts;
  • municipalities and their respective offices, including police forces;
  • local service districts, rural communities and regional service commissions;
  • public universities, CCNB, NBCC and NB College of Craft and Design;
  • other government agencies specifically designated in Schedule A of the Act, including:
    • Algonquin Properties Limited,
    • District Education Councils,
    • Opportunities New Brunswick,
    • Service New Brunswick, and
    • Recycle New Brunswick.

Who is not subject to the Act?

The Act applies to provincial and municipal entities and public universities, but does not apply to the following:

  • the offices of officers of the Legislative Assembly (the Speaker of the Legislative Assembly, the Clerk of the Legislative Assembly, and senior officers, including the Chief Electoral Officer, the Child, Youth and Elder Advocate, the Consumer Advocate for Insurance, the Integrity Commissioner, the Commissioner of Official Languages, and the Auditor General);
  • the courts of New Brunswick, including the Court of Appeal, the Court of King's Bench, the Provincial Court and the Small Claims Court;
  • private sector companies and entities.

The Act does not apply to certain types of documents, including information contained in court records, documents prepared by or for an officer of the Legislative Assembly, etc. The complete list of documents to which the Act does not apply can be found in section 4 of the Act.

Access to information and correction of personal information

How do I make an access to information request or ask for a correction to a document held by a public body?

You can make such a request directly to the public body that holds the information you are seeking or that you wish to have corrected. To do so, you can submit a written request or a duly completed form. To facilitate such requests, the province has prepared standardized forms for the public:

If you are submitting a written letter rather than a completed form, please ensure that you include the following:

  • your name and contact information (mailing address, telephone number and e-mail address);
  • the date of the request;
  • whether your request for access to or correction of a document is made under the Right to Information and Protection of Privacy Act;
  • the name of the company or organization on whose behalf you are making the request, if applicable;
  • whether you are requesting to examine the document or to receive a paper or electronic copy of the document.

You may find it useful to keep a copy of the request in case the public body has questions or needs clarification about your request, or in case you are not satisfied with the public body's response and wish to exercise your right to complain to our office or to refer the matter to the Court of King's Bench.
